1. Acceptance of the Terms and Conditions

By accessing the website https://neoheberg.fr and using the services offered by NeoHeberg, you acknowledge that you have read these Terms of Use and agree to comply with them in full. If you do not accept these terms, please do not use our services.

2. Description of Services

NeoHeberg is a free hosting platform that offers:

• Application services (Node.js, Python);
• The VPS (Virtual Private Server);
• Web hosting plans (static or dynamic websites).

All services are provided "as is," subject to available resources and the fair-use policy defined by NeoHeberg.

3. Account Creation and Access

To use our services, you must create an account. You are responsible for keeping your login credentials confidential and for all activities carried out through your account. You agree to provide accurate information and to keep it up to date. NeoHeberg reserves the right to refuse or suspend an account in the event of a breach of these Terms of Service.

4. Use of Services

You agree to use our services in a lawful and responsible manner. The following are strictly prohibited:

• Hosting, distributing, or sharing illegal content (child pornography, hate speech, glorification of terrorism, etc.);
• Infringe upon the intellectual property rights of others;
• Launching attacks (DoS, DDoS, brute force, etc.) from or to our infrastructure;
• Use the services for cryptocurrency mining, unless expressly authorized to do so;
• Work around technical limitations or resource constraints.

Any violation may result in the immediate suspension of service without notice and, if necessary, referral to the appropriate authorities.

5. Resources and the Coin System

NeoHeberg uses an internal virtual currency called Coins to bill for its services. Coins can be acquired in two ways:

• Purchase: You can purchase Coins using the available payment methods. The conversion rate is fixed: 1 Coin = €0.25 (including tax). Purchased Coins are non-refundable, unless otherwise required by law.
• Free of Charge: NeoHeberg may credit Coins to active accounts free of charge, for promotional or loyalty purposes. These free Coins have no monetary value and may be subject to specific terms of use.

Coins are used to activate or renew monthly subscriptions. They have no value outside the NeoHeberg platform and cannot be exchanged between users, unless a feature explicitly allows for it. NeoHeberg reserves the right to change the price of services in Coins, the conversion rate (after prior notice), or the terms for awarding free Coins.

Each account is entitled to one free VPS (“Free VPS”), which can be activated without using Coins. This offer is limited to one active free VPS per account: any additional VPS must be purchased with Coins.

6. User Responsibilities

As a user, you are solely responsible for:

• Content that you host and/or distribute through our services;
• Your account security (passwords, authentication tokens);
• Backups of your data. NeoHeberg is not responsible for any data loss;
• Compliance with the laws and regulations in effect in your country of residence and in France.

7. NeoHeberg's Responsibilities

NeoHeberg strives to ensure maximum availability of its services (with a target of 99.9% uptime) and implements technical measures to guarantee the security of its infrastructure (DDoS protection, regular backups). However, because the services are provided free of charge, NeoHeberg cannot be held liable for any service interruptions, data loss, malfunctions, or any indirect damages resulting from the use of the services.

8. Limitation of Liability

To the fullest extent permitted by French law, NeoHeberg disclaims all liability for any direct or indirect damages (loss of profits, loss of data, business interruption) that may arise from the use of or inability to use the services, even if NeoHeberg has been informed of the possibility of such damages.

9. Term and Termination

Services are subscribed to on a monthly, automatically renewing basis, subject to the availability of Coins in the account. You can cancel at any time through your customer portal. NeoHeberg reserves the right to suspend or terminate an account without notice in the event of a violation of the Terms of Service or prolonged inactivity (more than 6 months).

10. Changes to the Terms and Conditions

NeoHeberg may need to modify its Terms of Service to adapt to legal, technical, or economic changes. The new terms will be published on this page with a notice of update. Continued use of the services after such modifications constitutes acceptance of the new terms.

11. Intellectual Property

The NeoHeberg website, its logo, its graphic design, and all content (text, images, videos) are the exclusive property of NeoHeberg, unless otherwise stated. Any reproduction or display without authorization is prohibited.

12. Personal Information

NeoHeberg places particular importance on protecting your personal data. The processing of your information is governed by our Privacy Policy and the provisions of the General Data Protection Regulation (GDPR). You have the right to access, correct, and delete your data.
